Кипрский финансовый регулятор CySEC объявил о частичной приостановке действия лицензии, выданной розничному FOREX брокеру XTrade Europe Ltd., который владеет брендами XTrade и XForex. Причиной такого решения Кипрской Комиссии по ценным бумагам и биржам (CySEC) явилась недобросовестная маркетинговая и рекламная политика XTrade. CySEC считает, что XTrade использует недобросовестную рекламу, вводящую в заблуждение клиентов.

Частичная приостановка лицензии подразумевает запрет для XTrade на привлечение новых клиентов, при этом обслуживать уже существующих клиентов компании пока разрешено.

Регулятор дал компании XTrade месяц на исправление сложившейся ситуации. В случае игнорирования требований регулятора, деятельность XTrade может быть полностью заблокирована.

Обращение к компании Xtrade Europe Ltd.

Тема: Частичная приостановка торговой лицензии.

Комиссия по ценным бумагам и биржам Кипра (CySEC) объявила, что в соответствии с разделом 26 (2) Закона об инвестиционных услугах от 2007 года, разрешение кипрской инвестиционной компании Xtrade Europe Ltd (далее Компания) номер 108/10 вести финансовую деятельность и оказывать услуги финансового характера новым клиентам, частично приостановлено.

Причиной данного решения является подозрения в нарушении закона, а именно:

Раздел 36 (1), подпункты 1 и 2, Параграф 6, Директива DI144-2007-02 от 2012 года. Маркетинговые материалы, распространяемые Компанией, не кажутся справедливыми, ясными и вводят клиентов в заблуждение.

Данное решение было вынесено регулятором по причине подозрений в нарушениях закона, которые могут угрожать интересам клиентов Компании а также бесперебойной работе участников рынка.

У Компании есть 1 месяц, чтоб принять меры по устранению выше перечисленных нарушений.

Пока приостановление действия лицензии в силе, Компания:

1. Не может вступать в деловые отношения с новыми клиентами.
2. Не может получать, передавать или исполнять любые приказы от новых клиентов для покупки каких-либо финансовых инструментов.
3. Не может предоставлять любому новому клиенту любые инвестиционные услуги на территории или за пределами Кипра.
4. Не может распространять маркетинговые материалы с целью привлечения новых клиентов.
5. Обязана разместить на всех своих сайтах информацию о том, что торговая лицензия на предоставления финансовых услуг и осуществления финансовой деятельности новым клиентам была частично приостановлена.

Компания может продолжать предоставлять услуги финансового и инвестиционного характера своим существующим клиентам.

Отметим, что это уже не первая претензия от финансовых регуляторов к компании Xtrade. В 2016 году из-за задержек с выплатами денежных средств клиентам претензии к австралийскому подразделению XTrade предъявлял финансовый регулятор Австралии ASIC. В октябре 2016 года кипрский XTrade получил штраф от CySEC в размере € 225 000. Причиной недовольства регулятора явилась все та же недобросовестная рекламная и маркетинговая политика Xtrade.
